  • Force Majeure: The Event may be cancelled due to events beyond control, including wildfire risk or government orders. See Sections 3.5 and 16.

1. SCOPE, CONTRACTUAL PARTNERS & ASSIGNMENT

1.1 Contracting Party

1.2 Assignment to Operator

The participant acknowledges that the operational execution of the Event will be carried out by a Spanish entity (Sociedad Limitada - S.L.), which is currently in formation.

1.3 Transfer of Contract

Stelzinger GmbH shall transfer (assign) all rights and obligations arising from this contract to the Spanish operating entity (the "Operator") no later than sixty (60) calendar days before the first day of the Event. Upon completion of the transfer, the Operator assumes all contractual obligations towards ticket holders. Stelzinger GmbH shall notify all ticket holders by email of the transfer, including the Operator's full legal name, registered address, tax identification number (NIF), and contact details. Until such notification is sent, Stelzinger GmbH remains the responsible contracting party.

1.4 House Rules

In addition to these Terms, the House Rules displayed on-site and the regulations of the local Spanish authorities apply.

1.5 Insurance & Regulatory Compliance

The Operator maintains civil liability insurance (seguro de responsabilidad civil) as required by Ley 7/2006, de 2 de octubre, de Espectáculos Públicos y Actividades Recreativas de la Comunidad de Castilla y León, with coverage of no less than €2,000,000 (two million euros) for personal injury and property damage. The Event is operated under an approved Self-Protection Plan (Plan de Autoprotección) registered with the Regional Registry of Castilla y León in accordance with Real Decreto 393/2007. 1.6 Claims Against Legal Entity

All rights and obligations arising from these Terms exist exclusively between the participant and the Organizer as a legal entity. No claim may be brought personally against any director, officer, administrator, board member, employee, volunteer, or agent of the Organizer, the Operator, or any affiliated entity in their individual capacity, except where mandatory law provides otherwise.

2. AGE RESTRICTION & IDENTIFICATION

2.1 Age Policy

The Event is open to all ages. Participants under 18 years of age must be accompanied at all times by a parent or legal guardian who holds a valid ticket. The accompanying adult assumes full responsibility for the minor's safety and wellbeing throughout the Event. Children under 12 years of age do not require a ticket but must be accompanied by a ticketed parent or legal guardian at all times.

2.2 Valid Identification

Tickets are personalized. The Organizer may request valid photo ID to verify ticket holder identity. Accepted forms of identification include: Passport (any nationality), Spanish DNI, NIE, or National ID card from EU/EEA member states. We do not accept photocopies, student IDs, driving licenses (alone), or expired documents.

2.3 Refusal of Entry

Failure to provide acceptable identification when requested, or unaccompanied minors under 18, will result in refusal of entry without refund.

2.4 Alcohol Sales

Sale and service of alcohol to persons under 18 years of age is strictly prohibited in accordance with Spanish law. Proof of age may be required for purchase.

3. TICKETS, RESALE & REFUND POLICY

3.1 Personalization

Tickets are personalized and non-transferable except through authorized channels.

3.2 No Commercial Resale

Commercial resale of tickets (scalping) is strictly prohibited. Tickets sold via unauthorized third-party sites (e.g., Viagogo, eBay, Facebook) may be cancelled without compensation.

3.3 Authorized Resale & Transfer

Private resale or transfer is only permitted via authorized platforms designated by the Organizer (to be announced on the website) or by direct request to the Organizer via tickets@iberiaeclipse.com (transfer fee may apply).

3.4 No Right of Withdrawal

Ticket purchases for the Event are exempt from the statutory right of withdrawal (right of cancellation) under: (a) § 312g para. 2 no. 9 BGB (German Civil Code); (b) Article 103(l) of the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (Real Decreto Legislativo 1/2007, Spain); and (c) Article 16(l) of Directive 2011/83/EU (EU Consumer Rights Directive), each of which excludes contracts for leisure services provided on a specific date or period. All ticket sales are final.

3.5 Refund Policy

  • Tickets are non-refundable except as required by mandatory law.
  • If the Organizer cancels the Event entirely (not due to Force Majeure), ticket holders will be offered a refund of the ticket face value.
  • Handling/Administration Fees shown at sale may not be refundable if they are non-recoverable.
  • If the Event is rescheduled, tickets remain valid for the new dates. Ticket holders may request a full refund within 30 calendar days of the public announcement of the new dates.
  • Refund requests must be made via the Organizer's published process. The Organizer will process approved refunds within fifteen (15) working days of approval and, where practicable, via the original payment method.
  • Minor programme changes, artist cancellations, schedule adjustments, or adverse weather that does not prevent the Event do not entitle ticket holders to refunds.
  • Interruptions due to Force Majeure (see Section 3.6) do not entitle ticket holders to refunds except where mandatory law requires otherwise.
  • These provisions are subject to mandatory consumer protections; the Organizer will comply with statutory obligations.

3.6 Definition of Force Majeure

For the purposes of these Terms, "Force Majeure" means any event beyond the reasonable control of the Organizer, including but not limited to:

  • Natural disasters, including wildfire, earthquake, flood, or extreme weather events;
  • Epidemics, pandemics, or public health emergencies;
  • Acts of terrorism, war, civil unrest, or threat thereof;
  • Government orders, prohibitions, or restrictions, including evacuation orders, curfews, or event bans;
  • Failure of essential infrastructure (power, water, telecommunications) not caused by the Organizer;
  • Industrial action or strikes affecting essential suppliers;
  • Any other event that renders the staging of the Event impossible, illegal, or unsafe.

A partial Force Majeure event affecting only part of the programme or duration does not constitute cancellation of the Event as a whole.


4. WRISTBANDS & ADMISSION

4.1 Wristband Exchange

Upon first entry, the valid ticket must be exchanged for a festival wristband at the designated exchange points.

4.2 Wristband Rules

The wristband must be worn intact on the wrist for the entire duration of the Event. Wristbands are non-transferable. Damaged, cut, loose, or manipulated wristbands are invalid and do not entitle the holder to entry or re-entry.

4.3 Re-Entry

Re-entry is permitted while the wristband remains intact and properly worn. Removal or tampering invalidates the wristband.

4.4 Lost, Stolen, or Damaged Wristbands

Lost, stolen, or damaged wristbands are generally not replaced. In exceptional circumstances, a replacement may be issued at the on-site Incident Desk only after identity verification and purchase check. A replacement fee may apply.

4.5 Right of Admission

The Organizer reserves the right to refuse entry or remove any person who is an unaccompanied minor under 18, under the influence of drugs/alcohol, behaves aggressively, carries prohibited items, or breaches these Terms.

5. PROHIBITED ITEMS

To ensure safety and comfort, the following items are strictly prohibited on the festival and camping grounds:
  • Fire Hazards: Generators, charcoal grills, gas cookers (unless authorized by alert level), open flame devices, sky lanterns.
  • Pyrotechnics: Fireworks, flares, smoke bombs, sparklers.
  • Weapons: Knives, firearms, explosives, pepper spray, tasers, or any item usable as a weapon.
  • Drugs: Nitrous oxide (laughing gas) canisters/dispensers, illegal substances.
  • Glass: Glass bottles or containers (small cosmetic containers permitted in camping only; strict glass ban in stage areas).
  • Sound Equipment: Large PA systems, large Bluetooth speakers, amplifiers, megaphones.
  • Drones: UAVs, flying cameras, or remote-controlled aircraft.
  • Pro Equipment: Professional cameras/video gear (detachable lenses) without press accreditation.
  • Oversized Bags: Backpacks or bags exceeding 40 × 30 × 15 cm in stage areas.
Prohibited items will be confiscated and disposed of. They will not be returned.

6. CAMPING, FIRE SAFETY & ENVIRONMENT

6.1 Camping at Own Risk

Camping is at the participant's own risk. The Organizer accepts no liability for theft, loss, or damage to tents, vehicles, or personal belongings.

6.2 TOTAL FIRE BAN

Due to the extreme risk of wildfires in Spain in August, strict rules apply. Open fires, charcoal grills, candles, and sky lanterns are PROHIBITED. Gas cookers are conditional and permitted only if the local fire authority (Bomberos) alert level allows. Smoking is permitted in designated areas only.

6.3 Leave No Trace

Participants must keep their camping area clean and remove all belongings and rubbish upon departure. A trash deposit (Pfand) system may be in place.

6.4 Vehicles

Sleeping in vehicles (cars, vans, campers) is only permitted in designated camper/van areas, not in the general car park.

7. SOLAR ECLIPSE SAFETY

7.1 Warning

The Event includes observation of a total solar eclipse on 12 August 2026. Looking directly at the sun—even during partial phases—can cause permanent, irreversible eye damage (solar retinopathy) or blindness. This damage can occur within seconds.

7.2 Eye Protection Requirements

The Organizer strongly advises all participants to use only eyewear certified to ISO 12312-2 standards ("eclipse glasses"). Regular sunglasses do NOT provide adequate protection.

7.3 Safe Viewing

Only during totality (when the sun is completely covered) is it safe to view with the naked eye. Before and after totality, certified eye protection is mandatory.

7.4 Disclaimer

The Organizer assumes no liability for eye injuries resulting from failure to follow safety instructions or use of non-certified/damaged protective eyewear.

8. HEALTH, SAFETY & WELFARE

8.1 Medical Services

Medical and welfare services will be available on-site.

8.2 Hearing Damage

Sound pressure levels may exceed 85 dB. Prolonged exposure can cause permanent hearing damage. Participants are strongly advised to wear earplugs.

8.3 Environmental Factors

The Event takes place in a natural setting in Spain. Participants must be prepared for extreme heat (35°C+), strong sun, uneven terrain, dust, and insects. Adequate hydration is the participant's responsibility.

8.4 Assumption of Risk & Voluntary Participation

The Event takes place in a rural, natural environment in Spain during the month of August. By purchasing a ticket and attending the Event, the participant acknowledges and voluntarily assumes the inherent risks associated with attendance, including but not limited to: exposure to extreme heat (temperatures may exceed 40°C), intense UV radiation, and risk of heat-related illness; uneven, unpaved, and potentially unstable terrain, including slopes, forested areas, and lakeside paths; insect bites and stings, contact with wildlife, and allergens present in a natural setting; dust, smoke, and airborne particulates; noise levels that may cause hearing damage (see Section 8.2); crowd density, including risks associated with large gatherings at stages and communal areas; the inherent risks of camping in an outdoor environment, including weather exposure; and physical exertion associated with navigating the festival site on foot. The participant confirms that they are physically and mentally fit to attend a multi-day outdoor event and that they have no medical condition that would make attendance inadvisable without first consulting a medical professional.

8.5 Participant Conduct & Indemnification

The participant agrees to comply with these Terms, the House Rules, all instructions from the Organizer's staff and security personnel, and all applicable Spanish laws and regulations while on the Event premises. The participant shall indemnify and hold harmless the Organizer, the Operator, their respective directors, officers, employees, agents, and volunteers from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) the participant's breach of these Terms or the House Rules; (b) the participant's violation of any applicable law or regulation; (c) the participant's negligent or intentional acts causing harm to other participants, staff, third parties, or the Event premises; or (d) any false or misleading information provided by the participant in connection with ticket purchase or event registration. This indemnification obligation survives the conclusion of the Event.

9. ACCESSIBILITY

9.1 Commitment

The Organizer is committed to making the Event as accessible as possible.

9.2 Accessibility Requests

Participants requiring accommodations (e.g., accessible viewing areas/camping) should contact us in advance at accessibility@iberiaeclipse.com.

9.3 Companion Tickets

There is no automatic entitlement to free companion tickets. Requests will be considered on a case-by-case basis subject to verification of need.

10. CASHLESS PAYMENT

10.1 System

The Organizer reserves the right to implement a cashless payment system (e.g., RFID wristband) for all on-site transactions.

10.2 Top-Up & Refunds

Remaining balance on the cashless system can be refunded after the Event. Specific terms and potential processing fees will be published on the website prior to the Event.

11. MEDIA & RECORDING

11.1 Consent to Recording

By attending the Event, the participant grants the Organizer an irrevocable, worldwide, royalty-free licence to use photographs and video recordings in which the participant appears for promotional and documentary purposes without compensation.

11.2 Professional Recording

Professional or commercial photography, filming, or audio recording requires prior written permission. Unauthorized professional equipment may be confiscated.

12. LIABILITY

12.1 Unlimited Liability

The Organizer is liable without limitation for damages to life, body, and health caused by negligent or intentional breach of duty by the Organizer, its legal representatives, or its vicarious agents. This provision is mandatory under both German and Spanish law and cannot be excluded or limited.

12.2 Limited Liability

For damages other than those covered by Section 12.1, the Organizer's liability is limited as follows: (a) The Organizer is liable for damages caused by intentional or grossly negligent acts of the Organizer, its legal representatives, or its vicarious agents. (b) For slight negligence, the Organizer is liable only for breach of essential contractual obligations (Kardinalpflichten / obligaciones contractuales esenciales). In such cases, liability is limited to the foreseeable, contract-typical damage. (c) Aggregate Liability Cap: The Organizer's total aggregate liability under these Terms (excluding liability under Section 12.1) shall not exceed the greater of: (i) the total ticket price paid by the affected participant, or (ii) €500 (five hundred euros) per participant. (d) This limitation applies regardless of the legal basis of the claim (contract, tort, or otherwise), except where mandatory law provides otherwise.

12.3 Exclusions

To the fullest extent permitted by applicable law, the Organizer shall not be liable for: (a) loss, theft, or damage to personal property, tents, vehicles, or equipment brought to the Event by participants; (b) adverse weather conditions, including but not limited to extreme heat, rain, wind, dust storms, or wildfire smoke affecting air quality; (c) eye injuries, including solar retinopathy, resulting from failure to use or the improper use of eclipse-viewing eyewear, whether or not such eyewear was provided, recommended, or sold by the Organizer; (d) acts, omissions, or negligence of third parties, including but not limited to other participants, independent contractors, vendors, concession operators, food and beverage providers, and performers; (e) disruption, delay, cancellation, or modification of the programme, schedule, or artist lineup; (f) failure, interruption, or inadequacy of mobile network coverage, internet connectivity, or cashless payment systems; (g) injury or illness arising from pre-existing medical conditions, self-administered substances, or the participant's failure to follow safety instructions; (h) any damage, loss, or injury arising from the participant's breach of these Terms, the House Rules, or applicable law.

12.4 Independent Contractors & Third-Party Services

Certain services at the Event (including but not limited to food and beverages, wellness activities, and stage production) may be provided by independent third-party contractors. These contractors operate under their own responsibility and maintain their own civil liability insurance. The Organizer is not a party to any contract between the participant and such third-party providers, and shall not be liable for the quality, safety, or availability of their services. Claims relating to third-party services must be directed to the relevant provider.

13. DATA PROTECTION & PRIVACY

Personal data is processed by Stelzinger GmbH (and, after transfer, the Spanish S.L.) in accordance with applicable data protection laws (GDPR). Full details are available in our Privacy Policy.

14. COMPLAINTS & DISPUTE RESOLUTION

14.1 General Inquiries

14.2 Online Dispute Resolution (ODR)

For unresolved disputes arising from online ticket purchases, consumers resident in the EU may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/

15. GOVERNING LAW & JURISDICTION

15.1 Governing Law

(a) Prior to transfer of the contract to the Operator (see Section 1.3), these Terms are governed by the laws of the Federal Republic of Germany. (b) Following transfer of the contract to the Operator, these Terms shall be governed by the laws of the Kingdom of Spain. (c) Regardless of the governing law, the participant retains the benefit of any mandatory consumer protection provisions of the law of the country in which the participant is habitually resident, in accordance with Article 6(2) of Regulation (EC) No 593/2008 (Rome I). (d) All matters arising from on-site safety, security, public health, environmental protection, fire safety, alcohol regulation, and public order during the Event are subject exclusively to the mandatory laws of Spain, in particular the laws of the Autonomous Community of Castilla y León.

15.2 Jurisdiction

(a) Prior to transfer: disputes arising from these Terms shall be subject to the jurisdiction of the courts of Berlin, Germany. (b) Following transfer: disputes arising from these Terms shall be subject to the jurisdiction of the courts of Soria, Spain, being the judicial district in which the Event takes place. (c) Notwithstanding the above, consumers habitually resident in the EU may bring proceedings in the courts of their domicile in accordance with Article 18 of Regulation (EU) No 1215/2012 (Brussels I Recast). (d) Nothing in this Section limits any right of the participant to bring a claim before any court having mandatory jurisdiction under applicable law.

15.3 Alternative Dispute Resolution

The Organizer is committed to resolving disputes amicably. Participants are encouraged to contact tickets@iberiaeclipse.com before initiating legal proceedings. For the EU Online Dispute Resolution platform, see Section 14.2.

16. FORCE MAJEURE

16.1 Definition

"Force Majeure" has the meaning given in Section 3.6.

16.2 Consequences of Force Majeure

If a Force Majeure event prevents, delays, or materially impairs the staging of the Event:

  • The Organizer shall use reasonable efforts to mitigate the impact and, where possible, reschedule or modify the Event programme.
  • The Organizer shall notify ticket holders as soon as practicable via the email address provided at ticket purchase.
  • The Organizer shall not be in breach of these Terms, nor liable for any damages, losses, costs, or expenses arising from or related to the Force Majeure event, except as required by mandatory law.
  • If the Event is cancelled entirely due to Force Majeure, the Organizer shall offer ticket holders, at the Organizer's discretion: (i) a credit voucher valid for a future event organized by the Organizer within 24 months; or (ii) a partial refund reflecting unrecoverable costs already incurred, calculated transparently and communicated to ticket holders.

16.3 No Obligation to Re-Stage

The Organizer is under no obligation to re-stage the Event at an alternative location, date, or format following a Force Majeure cancellation.

16.4 Government Orders

Without limiting the generality of Section 3.6, any order, directive, or recommendation by a Spanish national, regional, or municipal authority (including the Junta de Castilla y León, the Agencia de Protección Civil, or the Cuerpo de Bomberos) that prevents, restricts, or makes inadvisable the holding of the Event shall constitute a Force Majeure event.


17. AMENDMENTS

The Organizer may update these Terms from time to time. The "Last Updated" date indicates the most recent revision. Material changes affecting ticket holders will be communicated by email.
